AN ORDINANCE TO AMEND SECTION 6 OF “AN
ORDINANCE ADOPTING AN ETHICS CODE” APPROVED BY THE

WHEREAS, The General Assembly
adopted and the Governor signed into law, the Comprehensive Governmental Ethics
Reform Act of 2006, encoded at Tennessee Code Annotated sections 8-17-101, et
seq.; and,
WHEREAS, That law required all
counties in Tennessee to adopt an ethics policy for all county elected officials
and employees, the election commission, and the county school board, by June 30,
2007; and,
WHEREAS, This Board of County
Commissioners adopted item number 50 on June 25, 2007, titled “An Ordinance
Adopting a Code of Ethics; and
WHEREAS, This Board of County
Commissioners desires to amend Section 6 of this Ethics Policy to clarify
certain language under the category “Acceptance of Gifts and Other Things of
Value”.
NOW, THEREFORE, BE IT ORDAINED, By the Shelby County Board of
Commissioners, that the Code of Ethics adopted by the Board of Commissioners on
June 25, 2007 is hereby amended to delete the existing Section 6 of the
ordinance in its entirety and replaced to read as follows:
Section
6. Acceptance of gifts and other things of value.
An Official, Employee, Appointee, or their spouse or child living
in the same household, shall not accept, directly or indirectly, any
gift, money, gratuity, or other consideration or favor of any kind from anyone
other than the County for the performance of an act, or refraining
from performance of an act, that he would be expected to perform, or refrain
from performing, in the regular course of his County duties.
An
elected official shall not accept any entertainment, food,
refreshments, meals, health screenings, amenities, foodstuffs, beverages, or
other items with a value in excess of $200 in a calendar year from any
Prohibited Source or single entity which conducts business with the County or
appears before the board of county commissioners.
Excepted are meals and entertainment offered as part of events sponsored
by public or quasi-public entities, community organizations, or non-profit
charitable or educational organizations.
Each
Prohibited Source shall disclose, on a quarterly calendar basis in writing to
the Ethics Officer, all gratuities that it has given to Officials, Employees,
and Appointees during the preceding quarter.
Notwithstanding
anything in this code of ordinances to the contrary, an individual may accept
any offer of items described in paragraph two of this section regardless of value,
provided that the same items are offered at the same time to the public
generally or to all the
Board of County Commissioners and/or any other individuals in the same class of
Officials, Employees, or Appointees.
It shall not be necessary for a Prohibited Source to report items so
offered and given.
BE IT FURTHER ORDAINED, That
upon passage of this revised Ordinance by the Board of County Commissioners, and
its signing into law by the Mayor, that the chief administrator of the Board of
County Commissioners shall cause a copy of it to be filed with the Tennessee
Ethics Commission.
BE IT FURTHER ORDAINED, That
this Ordinance shall become effective fifteen
days after its adoption.
